Dear Colleague,

You will no doubt have heard the news that yesterday the European Court of Justice (ECJ) upheld one of the key elements of British health and safety law

- the use of the key phrase "so far as is reasonably practicable".

Finally the ECJ has rejected the European Commission's claim that the use of "so far as is reasonably practicable" does not implement the Framework Directive.

This judgement represents the end of a long and tortuous process; a victory finally for common sense - due in no small measure to years of hard work put in by the UK's representatives!
