Can we ask health related questions of new starters and record the finding of occupational health checks carried out on new starters?

The Equality Act 2010 limits the circumstances when employers can ask pre-employment health-related questions before offering the position.

Our motives are we want to record if anyone who starts work with us has any existing health problems that could be further aggravated by doing the job that they are employed to do. If a new employee has a pre-existing health problem that could give rise to a future compensation claim how do we prove that the problem hasnít been caused by working with us but was caused in a previous employment?

The Equality Act is certainly a hot topic at the moment, so we have arranged for Amar Tembi of the EEF to speak at our January meeting on the subject. If there are any specific questions that you would like answering post them on this link and we can put them through to Amar.
