The European Parliament have backed the first reading approval of the RoHS recast – 640 in favour, with 3 against and 12 abstentions.

This process formalises MEP’s approval of an agreement to update the RoHS Directive (2002/95/EC) on the restriction of the use of certain hazardous substances in electrical and electronic equipment.

The recast directive will enter into force 20 days after publication in the official journal of the European Union and member states will have 18 months to transpose the directive into national law.

Key Changes include:
  • Photovoltaic solar panels, fixed industrial machinery and military material will remain exempted from the requirements of RoHS, whilst all other electrical and electronic equipment will be covered – following an eight year transition period after the updated directive enters into force;
  • The proposed list of 37 restricted substances has been dropped, as have proposed restrictions on nanosilver and carbon nanotubes – with restrictions remaining as the original six substances (Lead, Mercury, Cadmium, Hexavalent Chromium, Polybrominated biphenyls (PBB) and Polybrominated diphenyl ethers (PBDE));
  • Restrictions will be reviewed three years after the recast enters into force;
  • The proposed list of priority substances for restriction (Annex III), which could have led to discrimination against whole classes of substances without scientific evidence, has been removed from the recast;
  • Nanomaterials will also come under increased scientific scrutiny and review;
  • An explicit request for coherence between RoHS and REACH methodology for risk assessment has been included;

Update - Following agreement of the recast RoHS directive at first reading of the European Parliament on the 24 November 2011, the recast failed its’ first reading by the council on 20 December 2011 due to translational problems.

The recast directive is now expected to be approved in the European Council later this quarter.

Following agreement by the council the directive will be published in the official journal and member states will then have 18 months to transpose the directive into national law.
